对经济法基石范畴与价值追求的反思

社会整体利益作为经济法的基石范畴,几乎已经成为了所有经济法学者的共识.在此基础之上,经济法则有其独特的价值追求,即社会整体效益,法和效益通过法所保护的利益联系起来,利益是法的基石,而对效益的追求则是法的价值之一.因此,经济法保护的应是社会整体利益,所追求的应是社会整体效益.

The Introspection of Foundation Stone and Value Pursuit on Economic Law

It's almost a consensus to all the economic law scholars that the social whole interest is the foundation stone of economic law.And on this base,economic law has its own value pursuit,namely the social whole benefit.The law and benefit is connected via the interest protecting by the law.The interest is the foundation stone of the law and the pursuit of benefit is one of the law's value.So economic law should protect the social whole interest and pursue the social whole benefit.
