论土壤环境的保护、改善与风险防控

为切实保护土壤环境,防治和减少土壤污染,中国立法机关正在着手制定《土壤污染防治法》.针对中国土壤环境质量总体下降、土壤污染日趋严重的现状,如何结合中国土壤环境保护和土壤污染防治的实际情况,吸取西方国家"先污染,后治理"的惨痛教训,遵循土壤环境保护的客观规律,确立《土壤污染防治法》的基本原则和核心内容,是土壤污染防治立法的关键.中国土壤污染防治立法应在"保护优先、预防为主、风险防控,综合治理"基本原则指导下,以"土壤环境的保护、改善与风险防控"为其核心内容,设置《土壤污染防治法》的具体框架和条文.

On the Protection,Improvement and Risk Prevention of Soil

To effectively protect the soil, prevent and reduce soil pollution, China is working to enact Soil Pollution Prevention and Control Act.With respect to the present circumstances, china's soil environmental quality declines generally and soil pollution aggravates, the keystones of soil pollution prevention legislation are coordinating china's soil environmental protection with the reality of soil pollution prevention, learning the western painful lesson of "harnessing after pollution", following the objective principle of soil environmental protection and establishing basic principles and core content of the Soil Pollution Prevention and Control Act. Therefore,china's soil pollution prevention legislation shall, destructed by the basic principles of "protection priority, prevention primacy, risk control and comprehensive management", set the specific framework and provisions by setting "the protection of soil, improvement and control of risk" as its core area.
