依法治校与高校领导体制的改革完善

目前高校实行的党委领导下的校长负责制具有政治与管理上的积极功效，但也存在一些突出问题，如政治框架与法律框架不协调；法律文件和党内文件不一致，党委与行政分工不明、权责不清；主要领导人员职责与职权行使方式不清晰，相互关系不明确等。其危害一是人为制造矛盾，形成内耗，损害事业；二是人治化倾向严重，妨碍高校的持续发展。解决办法一是制度创新，建立事业法人治理结构，在保持党委制的同时实行校董会或理事会领导下的校长负责制；二是在现行体制内作局部性修补。

The University Administration in Accordance with Law & the Reform on the Higher Education Leadership Mechanism

At present, the president responsibility system under the supervision of the Communist Party Committee has achieved some positive effects in terms of politics and the University administration. However, such problems as inconsistency between the political and legal mechanism, the inconsistency between legal documents and Party documents, inevitably produce some negative effects. The solutions are, firstly, to innovate systems, to establish the nonprofit institutional corporate governance, and to maintain the leadership system of Party Committee while implementing the president responsibility system under the university board of directors or council; secondly, certain alterations have to be made within the existing mechanism.
