我国社会组织管理法治化的制度建构--基于社会组织功能定位的分析

社会组织是社会治理的重要主体和依托，在推进国家治理体系和治理能力的现代化中起着重要作用。现行社会组织管理体制中存在的诸多问题，根源在于对社会组织认识的偏差，致使相关权责规定的缺失和司法介入的困难。要形成“政社分开、权责明确、依法自治”的现代社会组织体制，推进社会组织管理的法治化，需要从构建以保障公民结社权为目标的社会组织管理体制入手，明确社会组织的法律地位，完善责任制度，实现社会组织从国家模式向社会模式的转向。

The System Construction of Management Legalization of Chinese Social Organizations---An Analysis Based on the Functional Location of Social Organizations

As the principal subject and support of social governance ,social organizations play a critical role in promoting the modernization of the national governance system and capacity .However ,in the existing management system of social organizations ,there are still many problems rooted in the misunderstanding of the social organizations ,w hich leads to the absence of related provisions of the rights and responsibili‐ties and the difficulty of judicial intervention .In order to establish the modern system of social organiza‐tions with“separation between government and community ,clearly defined rights and responsibilities and self‐governing by laws”and promote the legalization of the management of social organizations ,it is es‐sential to start from the construction of the management system of social organizations toward the target of guaranteeing the citizens’ right of association ,to specify the legal status of social organizations ,to im‐prove the responsibility system and to realize the transformation of social organizations from the national pattern to the social one .
