| 摘 要： | 回顾了我国夫妻财产制的历史发展 ,探讨了身份与契约在夫妻财产制中的地位 ,通过分析认为对待不同时期的夫妻财产制只能用“历史的眼光”语境化地理解 ,而不是以今天的自我道德优越的眼光审视历史 ,把复杂的历史问题都作一种道德化的处理。
