| 摘 要： | 从法哲学视角对综合法学代表博登海默法律哲学的核心观点进行探讨,笔者提出了不同于博氏的主要观点有:社会对秩序的需求不仅源自心理,而是受制于更具终极性的“存在”;法律秩序是一种“公设人为”的极具主观性的制度,等等。

| Abstract: | The fundamental views of Bodenheimes' law philosophy which represents the integrative jurisprudence are discussed.Some different ideas from Bodenheimes' are proposed.For example,the demand to order of the public originates not only from the psychological factor but also from the objective factor,and the legal order,which is set up by public and maintained by people, is an artificial system and so on. |
