| 摘 要： | 夫妻间的同居义务是夫妻其他权利与义务的基础。国外有相关的立法规定。我国现行婚姻法对此问题的规定还是半遮半露。笔者建议对夫妻间的同居义务作出积极的立法规定 ,并对不履行同居义务的抗辩事由以及无故不履行同居义务的相应救济措施提出了自己的一些看法。

| Abstract: | The obligation of cohabitation of spouses is the basis of marital rights. It has been stipulated in family law of many countries. But in China there is ample room for argument about it. Legislation dealing with the obligation of cohabitation of spouses should inject itself into family law. It is time to amending and improving the conjugal relation law, such as deraignment with reason, means of redress and so on. |
