| 摘 要： | 当前耕地保护制度主要通过严格的行政管制控制耕地数量,面临着公平与效率的双重困境,这是现行耕地保护制度设计中的利益失衡的结果显现.运用在集体土地征收问题中并被广泛讨论的土地发展权概念,可解释此种利益失衡的实质原因,亦能为问题解决寻求法理依凭与法权基础.分析论证我国耕地发展权内容与主体,明确土地权属制度下耕地发展权内涵,在承认耕地发展权基础上建构保护模式.土地发展权的实现可平衡我国耕地保护制度公平与效率的关系,促进土地高效利用与城乡均衡发展.
