城市规划的风险预防理念贯彻与制度完善——以城市规划导致的被动性环境侵权为切入点

作为一种事前的计划和对城市物质形态的预先安排,城市规划对城市环境产生着重要的影响。而环境侵权后果的难以救济和难以恢复性特点决定了城市规划必须积极避免可能带来的环境风险。可见,城市规划的这一现实要求与环境保护的预防性需求之间存在着内在一致性。城市规划相关立法应以规划环境影响评价为核心构筑预防性制度内容,应着重对规划环评的公众参与、法律责任、可操作性及相关法律的衔接和协调等方面加以规范和完善。
