| 摘 要： | 现代西方法律思想随着社会的进步不断向多元化,跨领域更深入地发展,正义思想也得到了丰富.西方法学家对正义的探讨,思想的碰撞带给人们极大的启发.正义作为人类追求美好幸福必须坚持的原则,是文明的必要基础之一,它在社会制度的进程中尤为重要,是不可缺少的因素.正义指导着法律制度体系的完善,而法律应当体现正义的要求.正义还作为一种思想理念,体现了人的内在品质,但是其价值的判断是主观的、相对的、大多数人的.

| Abstract: | With the advancement of the society,the ideology of modern western law has been deeply developing to be pluralistic.And the ideology on justice has also been enriched.The discussions as well as the disputations on it,done by the western jurists,greatly enlighten people.Being a necessary principle of pursuing the welfare, justivce is one base for civilization and plays an important role during the advancement of the social institution. Justice perfects the system of law and the law should embody justice.Besides,being an ideology,justice is the subjective and relative reflection of person(?)'s internal qualities. |
