| 摘 要： | 随着中国改革开放的深入和社会主义市场经济的进一步发展，中国的市民社会逐步兴起，市民社会与政治国家逐渐分离。这种分离为中国走向法治奠定了坚实的社会基础。公权力制约与私权利保护、法治精神的孕育、良法的产生及市民守法精神的培育自此有了深厚的社会土壤。

| Abstract: | With China＇s reform and opening up and socialist market economy and the further development of China＇s gradual emergence of civil society, civil society and political separation of the country gradually. This separation of the rule of law in China has laid a solid social foundation. Public power and private fight to protect, nurture the spirit of the rule of law, good law and the public have to cultivate the spirit of the law since then have profound social soil. |
