司法违纪责任追究:现状、问题、出路

我国对违纪法官、检察官的责任追究由其所在单位负责，并以内部行政审批式的程序运行，存在追究主体缺乏独立性和中立性，追究方式呈现分散化，追究程序内部化和行政化的重大缺陷。设立统一独立、外部性的司法违纪责任追究主体，适用诉讼化追究程序，是追究司法违纪责任公正性和科学性的基本要求。

The Investigation and Sanction of Judicial Disciplinary Responsibility: Current Situation, Problems and Solutions

In China, the work unit of judge or prosecutor is responsible for the investigation and sanction of judicial disciplinary responsibility, the handling procedure of which is a kind of internal administrative examination. Such procedure has many deficiencies, such as lack of independence and neutrality on the part of the investigator, decentralization of investigation mode and internalization and administration of the procedure. To establish a unified independent unit with externality to investigate and deal with judicial disciplinary responsibility and use litigation procedure are essential requirements for a fair and scientific system of investigation and sanction of judicial disciplinary responsibility.
