| 摘 要： | 霍布斯自由概念的确切意义是外在障碍的不存在状态，这一含义割断了自由与能力的关系。通过这种区分，霍布斯在规范层面上得出臣民自由在于法律的沉默的结论，但同时又流露出对自由与法律是否相容观点上的依违不定的立场。霍布斯的自由概念忽略了人的行为的内在因素，因此在解释自由与义务的关系时面临着巨大的理论困境。

| Abstract: | The proper significance of Hobbes＇s Liberty lies in the absence of external impediments. It implies that liberty can be disjointed from power and will. Consequently, he concluded that liberty depends on the silence of law as to the social norms. Ignoring the internal dimension of human action, we would face many difficulties in understanding the relation between the liberty and obligation. |
