劳动契约的法经济学分析

对劳动契约概念的阐释表明,劳动契约的研究离不开对政府的研究。但在劳动法学界以对政府职能的理想假定为主,在劳动经济学界则对政府行为以"公共选择"解释为主,由此表明二者对于政府职能的研究存在"应然"与"实然"的脱节;其次,对于用人单位为什么违反劳动基准契约的解释上,劳动法学界对此的解释还是注释法学的路线,而且往往缺乏实证的调研,也没有将上述违约行为纳入法经济学的分析框架。经济学界虽然将违反劳动基准契约的行为有较多调研,但仅仅限于事实的描述,而没有将其纳入劳动基准契约的分析框架;最后,由于劳动争议处理体制的低效率而导致的"私力救济"、"地缘维权"或者政府行政介入,其本质上是一个契约执行机制的效率分析,而这恰恰是法经济学的经典分析主题。
