| 摘 要： | “人类共同利益”诞生于人类存在之初,但“人类共同继承财产”概念的提出,才标志着维护人类共同利益的国际法观念正式形成。随着全球化程度逐渐加深,“人类共同利益”日益凸显。“全球公域”、“人类共同关切事项”、“世界遗产”使“人类共同利益”观念深入到国际法的各领域。“人类共同利益”已在诸多国际条约中有所体现,且已具备强行法性质,符合国际法基本原则的构成要件,应成为国际法的基本原则。
