土地空间征收补偿问题研究

征收取得土地特定空间的使用权，必须对土地所有权人补偿。这种补偿的性质应该是财产权之限制所生特别牺牲之补偿。土地空间征收补偿的原则一般包括完全补偿说、相当补偿说及折中说三种。征收取得土地空间，应采取完全补偿的原则。征收取得土地空间的使用权后，其土地补偿的价格，与一般征收土地，取得其所有权的征收补偿不同。区分地上权之补偿因仅使用土地之上空或地下空间，其补偿系参酌临近土地或类似土地之正常交易价格乘以该特定土地立体利用阻碍率计算。
