摘    要:本文对我国妇女工作权的法律现状进行了全面的分析阐述。文章首先介绍了我国参加的与妇女工作权相关的主要国际公约,分析了国际法渊源对性别歧视的定义,并指出了我国承担的国际义务。文章第二部分对我国在妇女工作权方面的现行法律体系及改革进行了系统梳理,阐明了依据我国法律妇女工作权的主要内容,并对近期重要法律的制定和修改进行评述。文章第三部分在肯定既有成就的基础上对我国现行法律规范中存在的主要缺陷及实践中的问题进行了分析,指出了改革的方向。文章第四部分是全文的总结,提出消除关于性别的定型观念并推进决策过程中的性别主流化是实现男女两性平等的终极道路。

Abstract:The article makes a thorough analysis on the present legislations concerning the female right to work in China.It firstly introduces some main international conventions dealing with women's right to work which China has already supported.The definition of sex discrimination has been analyzed and China's international obligations have also been pointed out in this paper.The second part of the article reviews the present legal system of women's right to work in China and its reform,summarizes the main contents of women's right to work provided by law,and comments on the recent revision of laws and legislation progress.Based on the recognition of the achievements,the third part analyzes the principal faults in the legislations and the problems in practice,and points out the direction for the possible future reform.The last part gives a brief conclusion-eliminating the gender stereotypes in the society and accelerating the gender mainstreaming in decision-making process,which are the ultimate ways to realize the equality between men and women.
