| 摘 要： | 从形式上看,我国现行法允许农村土地承包经营权转让,但实质上,严格限制农村土地承包经营权转让。一方面,严格限制农村土地承包经营权转让存在一些弊端;另一方面,从比较法看,各国都对农村土地所有权、使用权的转让采用鼓励和支持的态度。因此完善承包经营权转让制度势在必行。

| Abstract: | It seems that the law of our country admit contractors to abaliente rural land contracted managerial right. However, it strictly limit contractors to do so in essence. There exist some disadvantages. On the other hand, other countries take encouraging and supporting attitude towards such abalienation. Thus it is necessary to improve the abalienation system on the perspective of rural land contracted managerial right. |
