| 摘 要： | 秦朝是中国第一个专制主义中央集权的统一政权，对秦律的研究一直是中国法制史学界关注的重要问题之一。秦律虽然严酷但却包含人道精神。人道精神和人道主义理论是既相联系又有所区别的。秦律在公共利益的维护、社会活动的管理、家庭关系的协调以及具体的司法活动等方面都体现了人道的精神。当然，对秦律中的人道精神应当给予理性的反思。

| Abstract: | The study of laws in the Qin Dynasty is one of the important issues in Chinese legal history because the Qin dynasty is the first unified regime of the autocratic centralization of state power in China. Although the laws are very harsh, they also contain the humanitarian spirit which is connected with and different from humanism. The hu manitarian spirit is embodied in public interests, social activities, family relation and judicial activities. However, the reasonable reflections should be made on the humanitarian spirit of laws in the Qin Dynasty. |
