违宪审查机制在解决法律纠纷和社会矛盾中的作用

在现代法治社会中，依法治国是最基本的治国理念，法律在解决各种纠纷和矛盾中发挥着非常重要的作用。但是，要严格实行法治原则，必须保证法制自身的统一性。法律之间的冲突和矛盾往往是导致社会纠纷和矛盾激化的重要因素，所以，为了确保法律在解决各种纠纷和矛盾中的基础作用，必须以宪法为依据，保证法律之间的协调和统一，其中，对违反宪法的法律、法规进行审查，是保证法制统一的重要措施。我国目前虽然已经在宪法和法律中已经建立了违宪审查制度，但是，由于缺少具体的程序和机制的保障，违宪审查制度还没有在维护法制的统一性中发挥应有的作用。加强违宪审查机制的建设是我国当前贯彻依法治国方略、促进社会和谐的重要措施。

A Research on the Function of the System of Review of Constitutionality in Resolving Various Legal disputes and Social Contradictions

In the modern constitutional society,it is the basic principle to manage state affairs in accordance with the law,and the law plays an important role in resolving legal disputes and contradictions.To strictly fulfill the principle of rule of law,it is necessary to guarantee the unity of legal institution.The conflicts between laws frequently lead to the intensity of social disputes and conflicts,therefore,it is essential to guarantee the coordination and unity of laws based on the constitution.It is an important measure to examine the laws and rules which are unconstitutional.Though judicial review system has been established in our country,it has not fully played its role in maintaining the unity of legal institution due to the lack concrete process and mechanism.It is important to strengthen the mechanism of review of constitutionality to carry out the principle of managing state affairs in accordance with the law and accelerate the harmony of society.
