同一行为重复处罚的禁止

立法者为了保护法益或者确保行政目的的达成,针对某些具有危害性的行为制定禁止规定,并对于违反者实施一定的制裁。而对于国家制裁手段的选择,立法者在刑事立法裁量权时,对危害性较大的行为采用严厉的刑事制裁,对危害较轻的行为则采用较轻的行政制裁。然而,不论是何种制裁手段,都是国家对被处罚人权利的限制或剥夺,因此,应从实质规范的角度判断制裁方式的性质与目的,避免造成同一行为的重复处罚。
