| 摘 要： | 为了最大可能地还原两宋士兵逃亡法的面貌,运用历史学研究理论与方法,对两宋士兵逃亡法内容进行了全面搜集与考察。研究认为:两宋时期,不仅不同军种、不同职责的士兵各有逃亡法;对于逃至敏感地区的士兵,统治者还颁布了一些特殊的法律条文。此外,两宋士兵逃亡法还包括首身法等诸多具体的律文,以及缉捕逃兵赏罚条例等配套法规。

| Abstract: | In order to return the soldier desertion law of the Song Dynasty to original condition, the historical theory and method is applied to collect and investigate its contents in full scale. It is believed that in the Song Dynasty, there are differences in the legislation of the soldier desertion law for the soldiers in different armed services and different function areas. And the rulers promulgate some special regulations for the soldiers decamping to the sensitive districts. Besides,the soldier desertion law also includes the surrender statute and the size of reward and punishment for the army deserters and so on. |
