| 摘 要： | 人类遗传资源具有不同于传统资源的特性，其具有属物性也具有属人性，其使用价值在一次性研发中转移，且具有多重权属。人类遗传资源的研发首先应当遵循事先知情同意原则，研发前告知其权属人并征得其同意；其次，应该遵循无伤原则，不能对当事人的身体及隐私造成伤害；再次,应遵循公平原则，资源的提供者和研发者利益共享；最后，应遵循正当原则，使用合法的手段获取研发材料。
