| 摘 要： | 我国农村宅基地使用权法律制度存在一些缺陷,其立法基础和标准不统一,导致现行相关法律规定相互矛盾.我国应确立完善的农村宅基地使用权登记制度,逐步建立农村宅基地有期限、有偿使用制度,在条件成熟时以立法形式规范农村宅基地使用权的流转.

| Abstract: | Some deficiencies exist in the system of the right to use the rural residential land in China: the basis of legislation and standards are not unified;and the current relevant laws and regulations contradict to each other.China should establish a sound registration system dealing with the right to use residential land,and implement a period of paid use of the rural house.When conditions are ripe,the state should regulate applying right and transfer of the rural house by legislation. |
