| 摘 要： | 现代国家是建立在现代经济和社会基础之上的,以国家主权和平等公民权为核心特征的国家形式。公民权是现代国家其国民基于成员身份而获得和承担的,为该国法律所确认的成员平等的权利和义务。本文在厘清现代国家与公民权关系的基础上,明确指出:公民权是现代国家的基石,现代国家是公民权的基本载体,宪政建设是现代国家成长和公民权保障的联系纽带和基本路径。
