| 摘 要： | 惩罚性赔偿具有补偿、惩罚、预防三大功能 ,当然 ,它也存在一些不足。国际社会采取四种措施对其进行完善 :1.较高的证明标准 ;2 .分离原则 ;3.最高数额限制 ;4 .征收税收。鉴于中国有关惩罚性赔偿实践中存在的一些问题 ,本文就中国惩罚性赔偿制度的具体适用进行了探讨

| Abstract: | Although punitive damages system has functions such as compensation, punishment and prevention, it has defects . Four methods are used to complete it by international society. They are: (1) higher certificating standard; (2) separating principle; (3) limited maximum amount; and(4) taxes levying. Due to some problems in the practice of punitive damages , the article analyses the application of the punitive damages system in China. |
