| 摘 要： | 诉讼制度的本质是由诉讼价值最终决定的,仅以诉讼形态的差异作为民事诉讼本质不同的依据是不充分的。客观真实诉讼价值是我国民事诉讼构造具有交涉性的决定性因素,民事司法改革只能在诉讼价值改变的前提下实现。

| Abstract: | The essence of procedural system is rested with the value of litigation. The differences of modes alone are not enough to show the differences of essences. Objective truth is the value of civil litigation in China, in which procedure is ignored. Legal truth as the new value of litigation is one of the preconditions to Chinese law reform. |
