| 摘 要： | 民主与法治作为现代政治追求的两个目标 ,存在着很强的一致性 :民主政治是法治的基础 ,它决定着法治的价值基础和效能 ;法治是民主的保障 ,它为民主提供前提、规则、权力制约机制和责任机制。另一方面 ,法治与民主也并不是完全契合的 ,两者在逻辑上以及实践中都存在着张力与矛盾

| Abstract: | Democracy and rule of law as the two goals pursued by contemporary politics have a strong consistent: democratic politics is the basis of rule of law, it decides the value base and performance of rule of law; rule of law is the guarantee of democracy, it provides the premises, rules, checks and balances and duty mechanisms for powers. On the other hand, rule of law and democracy are not exactly consistent, there have been contradictions and tensions existing between them. |
