土地承包关系长久不变与征地补偿标准

在土地承包关系长久不变的政策背景下,我国现行的征地补偿标准与十七届三中全会提出的合理补偿的目标有差距。征地补偿标准要合理,就要重新确立制订征地补偿标准的原则,增加制订对相关利益主体补偿的标准,明确现有土地补偿费、安置补助费的用途,制订综合考虑土地产值及土地承包权流转价格的征地补偿标准。最终政府退出土地一级市场,由征地单位与被征地农民谈判达成征地补偿标准。

Due to the durable policy of land contracted,some gap exists between the current status of the eminent domain compensation standard and the goal of fair compensation came up by the Third Plenary Session of the Seventeen Central Committee.Setting up a fair level of eminent domain compensation standard will highly rely on the followings:re-establish eminent domain compensation principle;add new laws for beneficiary's compensation items;definitize the usage of current land compensation and resettlement fees;set up an integrated eminent domain compensation standard considering the value of land and the transfer of the contractual right of land.Ultimately,the government exists the primary market and the eminent domain compensation standard is set up under the negotiation between the land requisitioned party and the local people.
