| 摘 要： | “法与（和）经济学”，又称“法律经济学”，或者“法律的经济分析”，这是对法与经济学的一般理解。实际上，法与经济学就其内涵来说，可以划分为以麦乐怡为代表的“广义的法与经济学”，以及以波斯纳为代表的“狭义的法与经济学”，它们之间不但研究的内容有所不同，而且研究的方法也有所区别。正确区分它们之间的不同，既有理论意义，也有着现实意义。

| Abstract: | Law and Economics,also called Economics of Law,or Economic Analysis of Law,is an common understanding of law and economics.In fact,in terms of connotations,it can be divided into theory a narrow sense and theory in a broad sense.They are different not only in contents but also in research methods.It is significant to identify the difference between them both in theory and practice. |
