| Abstract: | This paper articulated the substances and legal features of loan securitization and Asset-Backed Securities(ABS),explored legal issues about the bankrupt-remote mechanism,the legal status of Special Purpose Vehicle,the True Sale of loan assets,and the feature of Creditor's Claim.With an analysis of the legal environment for loan securitization in China,the author put forward some proposals for policy and legislation of loan securitization in China. |
