| 摘 要： | 自1949年中央人民政府司法部成立以来,我国司法行政机关共出现过三种定位,即国家司法行政机关、法院司法行政机关和行使部分司法行政权的国家司法行政机关。司法行政机关定位转变的因素是多方面的,如检察机关的一般监督职能和领导体制、法院地位的变化等。但在新的历史条件下,上述因素已经发生变化或消失,因此需要重新确定我国司法行政机关的定位及职权配置问题。

| Abstract: | Ever since the founding of the Ministry of Justice of the central government,the status of the judicial administrative department has changed from national department into judicial department and then into national department with some judicial administrative power.There are many reasons for such changes,including the changing functions of the procuratorate and the court.The above factors have changed or are no longer in existence.It follows that the status and power of the Department of Justice should be redefined. |
