| 摘 要： | 近年来,围绕生育权,法学界进行了较为热烈的探讨。这种探讨不仅存在于亲属法领域,而且也存在于人格权法领域。研究视角的不同,导致生育权的性质界定及法律阐释的差异与矛盾。为摆脱生育权研究的茫然与结论的多元,澄清生育权的价值认知与法律建构已成必然。

| Abstract: | In recent years,the right to procreate is discussed warmly in the law circle.The discussions exist not only in the field of the Family Law,but the field of the Personal Right Law.The character and legal ex- planation of the right to procreate which is discussed from the different angles have been defined differently and contradictorily.In order to get rid of the confusion and multivariate conclusions in the study on the right to procreate,it is necessary to clarify its value and legal structure. |
