中日澳植物新品种保护制度的比较

虽然我国与日本、澳大利亚三国都是UPOV公约成员国,但是由于执行的UPOV公约文本不同,三国在植物新品种的保护范围、保护力度、管理体制、审查与测试方式等诸多方面存在显著差异。本文着重讨论日本《农业种子和种苗法》、澳大利亚《植物育种者权利法》的特点,并与我国《植物新品种保护条例》比较,阐述三国植物新品种保护制度的异同,提出对我国《植物新品种保护条例》进行修订的必要性。

Comparison of New Plant Variety Protection Systems in China, Japan and Australia
