| 摘 要： | 现行的法律法规对农村土地征收的规定已严重滞后,修改宪法和其他法律的一系列规定已成为必要。本文通过对农地征收的主体、征收性质、所有权的归属、现行的制度设计等进行探讨,认为应当改革现行的征地制度,尽快修订相关法律,对集体土地征收可参照《国有土地上房屋征收与补偿条例》的规定,建立具体合理的征地补偿机制等是解决问题的关键所在。
