| 摘 要： | 法律行为是指在法律上有意义的行为。法律行为由人的社会本质及人的生物性基础决定。合作-竞争是法律行为的"理想"类型。合作-竞争模式法律行为寓意为:合作中有竞争,竞争中有合作。人的本能的自利性,从而引起利己与利他的对立统一,是合作-竞争的生物性基础;而人的需要的无限性与资源的有限性的对立统一,是合作-竞争的物质性基础;人的社会性与个性的对立统一,是合作-竞争的社会性基础;人的理性的有限性和客观必然性的复杂性的对立统一,是合作-竞争的认识论基础。合作-竞争这一法律行为模型的确立,确证了人的自由的本质,也确证了国家与市民社会的对立统一。这为架构国家与市民社会以新的启示,同时也为揭示法的深层次社会本质提供了一条线索。
