亲子鉴定相关法律问题

我国法律未对亲子鉴定作出明确规定,导致适用不规范。亲子鉴定是一项责任重大的专门技术工作,直接关系个人、家庭的利益及社会的稳定。亲子鉴定中关键的问题是合理规范亲子鉴定的程序、方式和在一方当事人或第三人拒绝进行亲子鉴定时的处理方式。目前急需建立亲子鉴定委员会制度、法定的鉴定部门及鉴定人资质的认定制度,统一亲子鉴定技术标准,规范其健康发展。应合理地分配当事人的举证责任,维护子女的最佳利益。

Study on the Legal Problems Related to Paternity Testing

There are no explicit provisions on paternity testing in china law,which brings about abnormal applio- cable.Paternity testing is a professional technological work with highly liablity,which is related to interests of peo- ple and families and social stability.It is the key to deal with paternity testing that we should standardize paternity test procedure,way and treatment way when one party or the third person refuses to carry on paternity test rational- ly.In order to standardize paternity test in a healthy way,we have to set up the system of parent-offspring's evalu- ation committee,legal qualification department and system of asserting of surveyor's human quality and unifiy pater- nity test technological quality level.It is very important to allot the burden of proof of the party concerned and therefore to protect the best interests of children.
