| 摘 要： | 由于美术作品与美术作品原件不可分离,美术作品著作权的保护成为著作权领域的特殊问题———美术作品著作权必须面对美术作品原件所有权。我国目前相关著作权理论与实践存在严重误区,由此导致美术作品原件所有人侵害美术作品著作权人利益的事件频频发生。比较发达国家相关著作权立法例,可为我国美术作品著作权保护提供借鉴。

| Abstract: | Since the fine art works can not be separated from its original, there arises a special problem with legal protection on the copyright of fine art works. This problem is the conflict between the copyright of fine art works and the proprietorship of the original copy.The theories available and practices so far are unable to deal with this problem,and a comparative study of legal protection on the copyright of fine art works can give us a great deal of enlightment. |
