摘    要:我国电子商务市场规模已连续数年居全球首位,但电商平台滥用"平台霸权",强迫平台内商家接受如"二选一"等不合理交易条件的行为时有发生.在现有竞争法体系难以规制此类行为的情况下,《中华人民共和国电子商务法》第35条确立了相对优势地位制度,为电商平台经营者滥用相对优势地位行为进行规制.然而,由于该条并未阐明适用范围以及适用标准,无法实现法律的可预测性和实效性,有必要对其进行进一步解释.通过考察各种观点,比较借鉴国外滥用优势地位相关制度的经验,建议明确《中华人民共和国电子商务法》第35条的适用既需要确定优势地位的存在,也需要对行为进行"合理性"分析,确保该条真正成为我国竞争法体系的有益补充.

Abstract:The scale of our country''s e-commerce market has ranked first in the world for several consecutive years. However, e-commerce platforms have abused "platform hegemony" and forced merchants on the platform to accept unreasonable trading conditions such as "either-or". When current law is difficult to regulate such behaviors. Article 35 of the E-Commerce Law of the People''s Republic of China introduces a comparative dominant position system to regulate the abuse of comparative dominant position by e-commerce platform operators. However, since this article does not clarify the scope of application and the applicable standards, the predictability and effectiveness of the law cannot be achieved, and it is necessary to further explain it. Through various viewpoints and comparatively drawing on the experience of foreign countries'' abuse of dominant position, it is suggested to clarify that the application of Article 35 of the E-Commerce Law requires not only the existence of the comparatively dominant position, but also the "reasonableness" analysis of the behavior to ensure this article to truly become a useful supplement to China''s competition law system.
