论创新性地方立法的良法标准

创新性立法是指地方立法机关为了填补法律、行政法规的空白以实现地方职能而进行的立法,具有地方性、创新性、暂时性等特征。创新性地方立法除了遵循一般的良法标准,还应该遵循特定的良法标准,这些标准包括合宪性、政策依据性、实验性、应急性、地方性和特别授权性。随着时代的变迁,创新性地方立法的发展趋势应该禁止地方立法涉及公民实体权利限制、缩小经济改革立法范围、大力倡导地方立法对弱势群体权益保障和社会公益保护立法,允许地方立法对地方公权力限制及公务员管理。实现创新性地方立法是良法的特定程序是:中央立法一旦制定,创新性地方立法要及时废止或变创新性地方立法为执行性地方立法。

A Trial Analysis of the Standards of Good Laws for the Innovative Local Legislation

Innovative legislation refers to the legislation of the local legislative organs for stuffing blanks of laws and administrative regulations so as to make the organs execute their duty in legislation. The innovative legislation is characterized with localization, innovation and temporary. In addition to fol- lowing the standards of common good laws, the innovative local legislation should also follow the special standards of good laws, which include constitutionality, policy-availability, experimental, emergency, lo- cality and special authorization. With the change of time, the developing tendency for the innovative local legislation should prohibit local legislation from limiting citizens＇ substantive rights. Legislative scope con- cerning economic reform should be downsized. The protection from the local legislation for the rights of the weak and social pubic benefits should be strengthened. The local legislation should be authorized with the power of limiting the public power and management of the public servants. The special procedure to en- sure the innovative local legislation to be a good law is： Once the legislation of the central government is implemented, the innovative local legislation should be timely abolished or be converted into implemen- ting local legislation.
