| 摘 要： | 把荣誉权与人格权、人身权、名誉权进行对比分析可以看出,荣誉权既不能简单地归类为人身权或人格权,也不能笼统地说荣誉权是名誉权的特殊情形。因为"特殊"一词有多种含义:"一般"和"超出一般常态的例外"间的并列关系中的特殊;"整体"和"特殊的局部"间的包容关系中的特殊;哲学意义上的"一般"和"特殊"关系中的特殊等。名誉权和荣誉权之间的关系应视为哲学意义上的一般和特殊的关系。因此,在民法中荣誉权应是名誉权下位阶的概念。

| Abstract: | Through comparing the concept of right of fame with that of right of reputation and personality right and status right,it can be seen that right of fame is unable simply to be classified as right of personality right or status right, neither can generally to con- sider right of fame as the unusual situation of right of reputation. Because this word ＂unusual＂ has many kinds of meanings： Peculiar; Special; Particular and so on. The relations between the right of reputation and the right of fame should be regarded as that of philosophie universality and philosophic parteularity. Therefore, the position of right of fame is lower than that of right of reputation in civil law. |
