| 摘 要： | 电子商务条件下的电子合同,固其相应证据的差异性区别于传统合同。确认电子合同的法律效力已成为确保商品交易安全的关键所在。解决电子合同法律效力问题,必须结合网络特点,确定电子合同程序和确认相关证据,以促进电子商务的发展。

| Abstract: | Electronic contract under the condition of electronic commerce differs from traditional contracts in respect of differences in relevant evidence. Affirming the legal effect of electronic contract has become the key to affirm the safety of trade. We must grasp the characteristics of network to solve the problem of legal effect of electronic contract. This is useful to determine the procedure of contract, affirm the relevant evidence and promote the development of electronic commerce. |
