| 摘 要： | 在社会与国家关系中的社会是一种利益共同体,既包括狭义的社会,又包括市场,国家则是对社会作出政治安排的权力系统,社会与国家两者之间具有互构的法理机制和解释机制。本文分别对我国社会转型加速期的法理机制和解释机制的变化和新情况做了分析。如果要实现权归于国家,就必须确保利归于社会。制度性行动与非制度性行动的互构关系进入了一个新时期,原有的制度性行动规则面临挑战。社会建设可以从更加合理地配置社会资源、更加有效地化解社会矛盾两个方面调节社会与国家关系。
