| 摘 要： | 动产的不特定性、流动性和一般动产物权以占有为公示方式的立法技术,决定了登记对抗主义适用于动产具有难以克服的缺陷和严重的不合理性。应当将动产抵押物限制在“准不动产”的范围之内,在该领域实行登记生效主义,并将部分适宜标示的其它动产也纳入可抵押的动产之列,辅之以标示的公示方法,这是能够从根源上解决问题的最佳方案。
