| 摘 要： | 自然法和法律实证主义是西方法理学研究中两种典型的研究进路,这两种进路在深层次上是具有相互融通的可能性的。自然法为法律的终极合法性提供了一个解释模型,而法律实证主义者则有意回避了基本规范的合法性问题,因为对这一问题的回答必然导致对自然法的肯定。正是对法律终极合法性的追问使自然法和法律实证主义这两种研究进路的融通变成可能。

| Abstract: | Natural law and legal positivism are two sorts of typical research ways in the study of the western jurisprudence.If we analyze them in deep level,we can find the possibility to combine the two kinds of study ways.Nature law theory provides an interpretation model of law’s ultimate validity,while legal positivists intentionally avoid the problem of the validity of the fundamental norms,because answering this question will inevitably lead to admission of natural law.It is the heckling on the law’s ultimate validity that makes the possibility of the combination of natural law and legal positivism. |
