| 摘 要： | 道德和法律之间有密切关系,因此道德总会通过各种方式影响司法。这种影响不仅表现为道德对司法有相应制约,也表现为道德在司法中有重要的补充作用。为此,从分析一些相关案例入手来研究道德对司法的影响是一种切实的方式和途径,同时,应该对这种影响的是非有清醒的认识。

| Abstract: | As there is close relationship between morality and law,the latter will by various modes influence the former.Such influence not only reflects in the relevant conditioning on the judiciary by morality,but also in its complementary functioning in the judiciary.Therefore,it is a practically applicable mode and approach to analyze the influence on the judiciary by morality by some relevant cases.And in the mean time,clear cognition on the righteousness and error of such influence should be kept. |
