学术论文剽窃的认定及法律责任

中国学术成果的借鉴与剽窃之间的界限原本就不十分清楚,反映在学术论文上就更加模糊。近年来,屡有学术论文抄袭、剽窃的事件曝光,但当事人极少认理服输,心悦诚服的承担侵权责任,通过对剽窃标准的认定及责任的探讨,认为这是涉及到中国著作权法立法、执法以及著作权人能否有效维权的至关重要的问题。

Cognizance Criterions and Legal Responsibility of Academic Thesis Plagiary

The dividing line between the reference and the piracy to academic production is too vague to distinguish,and that concerning academic theses is even more unclear.In recent years,not a few plagiary cases involved with academic theses have been exposed,but few of law-breakers are willing to admit their misconducts and assume the tort liability.The criterions for cognizing academic thesis piracy and assuming corresponding responsibilities are dealt with.This is one of the most important problems,not only to the legislation and execution of copyright law in China,but also to the protection of copyright holder.
