| 摘 要： | 汉代亲属关系同司法程序之间的关系密切。汉代的司法官吏往往根据当事人之间的亲属关系来决定是否受理,在审判时,又根据当事人的亲疏关系来决定判罚轻重。此外,汉代还形成了一些不成文的旨在维护特定亲属关系的司法规定及惯例,如亲亲相隐、代刑、株连等。
