我国公立高校教师聘任制的法理学分析

摘    要:由于我国现行法律、法规对公立高等学校的法律地位和性质,公立高校与教师之间的法律关系没有明确的规定,导致公立高校与教师之间聘任纠纷不能有效解决,影响了教师聘任制的实施。因此,对公立高校与教师之间的聘任关系进行法理分析并在此基础上讨论相应的对策,具有重要的意义。

Abstract:The contradiction between the teachers and public institutions of higher education can not be solved effectively for the absence of regulation of legal status and character in law or code.As a result,it has influenced implementing of teachers' employment reform.So it is very important to analyze in law the relationship between the teachers and public institutions of higher education.Some corresponding suggestion are also included in the paper.
