情事变更原则的价值研究

目前学界对情事变更的论述主要是解决我国合同法是否应该规定以及如何规定的问题，作者认为只要准确定位制度的立法价值，如何规定就是一个立法技术的问题，与其设想将来的法条如何规定，不如在对制度重新澄清的基础上研究情事变更原则的价值。讨论情事变更原则不是老生常谈，而是要通过对情事变更原则的讨论来正确把握契约自由与契约正义的平衡。从“契约恪守”到情事变更原则是正义内涵的发展和转变的一种体现。在审视德国的交易基础障碍制度的前提下，梳理情事变更原则存在于我国合同法的可能性。而当明确了民法制度的价值理性后，如何规定就是民法制度的形式理性问题，法律技术上的处理自然也就迎刃而解了。
